I actually have a lot of knowledge about brazilian history(long story) and it was so prevalent there that at one point it was codified into law that unless specifically refuted, the assumption was that the estate passed not to the children, but to the grandchildren directly.

Then the children would have gotten it from their grandfather...but what if there is no grandchildren..

As in the US intestate deaths with no heirs is covered by common law precepts. I dont know the specifics.
